Terms and Conditions

Welcome to Go Birdie Go. These Terms and Conditions (“Terms”) govern your use of the Go Birdie Go mobile application, website, and related services (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, please discontinue use.

1. Accounts and Eligibility

  • You must be at least 13 years old to use the Services.
  • Users located in California must be at least 16 years old, or have verifiable parental consent.
  • You agree to provide accurate account information and maintain the security of your login credentials.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

2. Subscriptions, Free Trials, and Billing

Free Trial

  • New and eligible returning users are entitled to a one-week free trial.
  • Any unused portion of the free trial will be forfeited upon purchasing a subscription.

Subscription

  • The Services operate on a subscription basis, granting access to premium features.
  • Subscriptions are available under Free, Pro, and Group Plans.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Group Plans allow up to five individual profiles, each with separate data and analytics.
  • All subscriptions can be managed through the App Store.

Billing and Payments

  • Subscription charges are processed by your app store provider (Apple App Store / Google Play) through RevenueCat.
  • Renewal charges are billed within 24 hours before the end of the subscription period.
  • By subscribing, you authorize the app store to charge your payment method for recurring fees until you cancel.

Cancellation and Refunds

  • Users may cancel subscriptions at any time through the App Store account settings.
  • All payments are non-refundable.
  • We reserve the right to cancel any transaction at our discretion; in such cases, you will receive a full refund.

3. Performance Data

By using the Services, you acknowledge that Go Birdie Go collects and analyzes golf performance data, including:

  • Putting results (made/missed, distance, slope, break)
  • Swing analysis (video, stroke, ball, and body mechanics)
  • Consistency scores
  • Strokes gained and player quality scoring
  • Goals and drills
  • Green condition inputs (stimp, slope, surface)
  • GPS/course data, round planning, shot tracking, and scorecards
  • Journals, notes, and club bag setup

This data is used to provide personalized feedback, analytics, and reports. Aggregated and anonymized data may also be used for benchmarks, marketing, and research, as described in our Privacy Policy.

4. User Content and Conduct

Users may upload or share content within Go Birdie Go, including swing and putting videos, journals, notes, comments, and feedback (“User Content”).

By submitting User Content, you agree that:

  • You are solely responsible for the content you post or share.
  • Content must not be unlawful, offensive, defamatory, obscene, harassing, or otherwise inappropriate.
  • Content must not infringe on intellectual property, privacy, or publicity rights of others.
  • Public content may be visible to other users, and Go Birdie Go cannot control how others use or share it.
  • We may review, remove, or restrict access to content that violates these Terms.
  • Accounts may be suspended or banned for violations, including abusive comments, harassment, or prohibited uploads.

5. Prohibited Use

You agree not to:

  • Copy, modify, or reverse engineer any part of the Services.
  • Attempt unauthorized access to the Services or related systems.
  • Interfere with the security, functionality, or integrity of the Services.
  • Use the Services for unlawful, fraudulent, or commercial purposes not intended by Go Birdie Go.

6. Third-Party Services

We use third-party services to support the Services, including but not limited to:

  • Firebase (data storage and authentication)
  • Google Analytics & Firebase Analytics (usage insights)
  • AdMob / AdSense (advertising)
  • RevenueCat (subscription management)

These services may collect or receive information as described in our Privacy Policy.

7. Intellectual Property

All content and materials provided through the Services, excluding User Content, are owned by Go Birdie Go or its licensors and protected by copyright, trademark, and other laws. You may not copy, distribute, or use our content without written permission.

8. User Rights (GDPR & CCPA)

Depending on your location, you may have the following rights under applicable laws such as the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA):

  • Right to access personal data we hold about you.
  • Right to request correction or deletion of your personal data.
  • Right to data portability.
  • Right to restrict or object to processing of personal data.
  • Right to opt out of the sale or sharing of personal data (we do not sell personal data).

9. Indemnification

You agree to indemnify, defend, and hold harmless Go Birdie Go, its affiliates, and employees from any claims, liabilities, damages, or expenses arising from:

  • Your use of the Services,
  • Your violation of these Terms,
  • Your User Content, or
  • Your violation of any rights of another.

10. Disclaimer of Warranties

The Services are provided “as is” and “as available.” We make no warranties, express or implied, regarding the operation, accuracy, or availability of the Services.

11. Limitation of Liability

To the maximum extent permitted by law, Go Birdie Go and its affiliates will not be liable for any damages arising out of or related to your use of the Services, including data loss, performance reliance, or loss of opportunity.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration in Illinois, unless otherwise required by law.

13. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full effect. These Terms constitute the entire agreement between you and Go Birdie Go regarding the Services, superseding all prior agreements.

14. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you within the app or by other means before they take effect.
